iHeartMedia faces lawsuit over fraudulent political activity in New Hampshire
iHeartMedia, the nation’s largest radio broadcaster, faces a lawsuit Thursday because of fraud and harassment against a New Hampshire congressional candidate. Andy Martin will file suit against iHeartMedia and its employees for engaging in a “continuing pastern of fraud and racketeering conduct” seeking to disrupt and harass his congressional campaign. In July, an iHeartMedia employee claimed “corporate” had flagged Andy’s ads. Then a Vice President at iHeartMedia corporate headquarters contradicted an email by a Manchester, NH station. Finally, Joe Graham produced “debate criteria” that were based on fraudulent and nonexistent claims. “iHeartMedia has refused to conduct bona fide news media activity, and has violated the Equal Time Rule by refusing to afford me time to respond to the corporate skullduggery. The only option is to file complaints with the FCC and with a court for money damages. The behavior of New England College is also disgraceful. The role of the Concord Monitor is unclear at this point,” Andy says. “Elections should be decided by voters, not by crooked media types seeking to fix elections to benefit liberal Democrats. Republicans can’t win in New Hampshire because the out-of-state-owned media are rigged in favor of liberal Democratic politicians. It’s a sad day for New Hampshire voters and students when crooked politics infects our election process.”

(Manchester, NH) (August 17, 2016) New Hampshire GOP congressional candidate Andy Martin will hold a telephone news conference Wednesday, August 17th to announce he is filing a lawsuit seeking damages from iHeartMedia and New England College for conducting fraudulent political activity in violation of FCC procedures. Hi Andy,
I’m hoping you can help me with an issue with your current radio spot. The spot was flagged by our corporate offices due to the content in the ad pertaining to Governor Hassan breaking the law.
I spoke with my GM here at the station and we would normally need proof in order to run an ad that specifically says the Governor broke the law. Is there any back up information you can provide our station so that we can continue running the ad?

“The email was clear that after ‘corporate’ acted, the employee spoke with Joe Graham, who demanded ‘proof.’
“A senior attorney at iHeartMedia contradicted the local station, and contradicted the claims of the low-level employee. Attorney Donna Schneider stated Joe Graham had directed the ad to air, when Amery’s email was clear that she spoke with Graham and he demanded ‘proof.’ The ‘corporate’ claim was a complete lie.

Mr. Martin – your ad was not reviewed by anyone at the corporate level. By “corporate offices,” the AE was referring to a corporate service we have called the “DubCenter.” The DubCenter, which is located in Cincinnati takes the voiced ads and puts them into the computer system that schedules and airs the ads. Someone at the DubCenter just alerted the AE to the content – something they will do on occasion. The ad was never stopped from being processed and was pushed down to the market after dubbing. The AE spoke with Joe Graham, the Market Manager, who then realized this was a campaign ad and informed the AE that it should be run as scheduled.

1. Does the candidate have an established, organized campaign/ground game
2. Does the candidate have a fundraising effort and has its activities been filed properly
3. Most importantly does candidate show with a 3% or larger percentage in 3 major polls.

“Graham now admitted that iHeartMedia had established ‘criteria’ with New England College.
“Taking Graham’s ‘criteria’ in reverse order, I am not aware of any ‘major poll’ that has polled my name. Thus Graham’s claim that ‘three major polls’ exist is objectively fraudulent. Before a poll can be valid, a candidate’s name has to be included. I have not seen my name included in any poll, which will be the subject of a separate lawsuit against WMUR and the University of New Hampshire which are also using rigged polls to favor liberal Democrats.
“Graham claims to have evaluated the ‘activities’ of candidates but how could he evaluate my campaign when he never contacted me and NEC never contacted me? Once again we see a bogus ‘criteria’ established which is open-ended and totally subjective. More fraud.
“Finally, Graham says he is looking at the candidates’ campaigns. My campaign is the only one advertising statewide across the whole district. My opponents lack the means and lack the resources to even advertise. How can someone run for congress across a sprawling district and not advertise? My opponents lack even the pretense of qualifications to be serious candidates for congress. How can they be considered ‘credible’ and I am not? Once again, more NEC lies and iHeartMedia fraud.
“It is disgraceful that New England College claims to be an academic institution and is instead instilling principles of fraud and deception in its students. iHeartMedia is governed by federal law. Broadcast licensees are not allowed to harass federal candidates and to defraud candidates with bogus claims and denials. While stations enjoy an exemption for ‘bona fide news,’ it is clear that iHeartMedia’s behavior has not been bona fide.
“I believe I have an excellent change of recovering money damages from the college, which has deep-pocketed trustees, and iHeartMedia. I hope the FCC also takes action against New Hampshire’s corrupt media.
“I will continue to advertise on the iHeartMedia stations because their licenses cover territory in my district and I am functionally compelled to do so. But I am under no illusion that Joe Graham is anything but an incompetent crook and a disgrace to the broadcasting industry. If I can, I will seek to combine with other creditors to see that iHeartMedia is placed in bankruptcy to prevent the company from defeating my claims for money damages.
“At this point I am not clear what role the Concord Monitor had other than allowing its name to be used. I am concerned about the Monitor’s role because it was mentioned in the LWV posting.”
